Terms of service

1. Who we are
SimRigKits.com is operated by The Trustee for ANTON INTERNATIONAL TRUST, ABN 22 583 327 828, trading as SimRigKits.com ("SimRigKits", "we", "us", "our"). We're based in Western Australia.
You can reach us by email at hello@simrigkits.com or by post at PO Box 388, Byford WA 6122. We handle all enquiries by email. We don't take phone calls. See our Contact page.

2. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't lawfully be excluded. If any part of these terms seems to say otherwise, that part doesn't apply to the extent it would do that.

3. Accepting these terms
These terms apply when you use simrigkits.com or buy from us. By placing an order, you agree to these terms and to the policies linked in them. Please read them before you order.

4. Orders

  • When you place an order, you're making an offer to buy. We'll email you an order confirmation. A contract is formed when we accept your order, which happens when we confirm it or process your payment, whichever comes first.
  • We may cancel an order and refund you in full if: the item is out of stock or no longer available from our suppliers; there's an obvious error in the price or description of the item on our website; we can't deliver to your address; or we reasonably suspect the order is fraudulent or unauthorised. If we cancel, we'll tell you by email and refund everything you paid for the cancelled items (including their shipping) to your original payment method. You don't have to pay anything extra.
  • If you want to cancel your order, email us as soon as possible. If it hasn't been dispatched by our supplier yet, we'll do our best to cancel it and refund you in full. Once an item has been dispatched, it's treated as a return under our Refund policy.

5. Prices and availability

  • All prices are in Australian dollars (AUD) and include GST. Shipping costs are shown at checkout before you pay.
  • Most of our products are supplied and shipped by our suppliers. Their prices and stock levels can change at short notice, so prices and availability on our website may change without notice. A price change won't affect an order we've already accepted, except as described in section 4 for obvious pricing errors.
  • Showing a product on our website doesn't guarantee it's in stock.

6. Payment

  • Payments are processed securely through Shopify Payments. We accept the payment methods shown at checkout.
  • Pay-later options (such as PayPal Pay in 4) may be offered at checkout. If you use one, your agreement with that provider is separate from your agreement with us, and their terms apply to the instalments.
  • We don't see or store your full card details.

7. Shipping and delivery
Most products ship directly to you from our suppliers' Australian warehouses. Dispatch and delivery times, costs, and what to do if something arrives damaged are explained in our Shipping policy. Delivery times are estimates. If something goes wrong with your delivery, email us and we'll sort it out with the supplier and carrier for you.

8. Perth pre-assembly service
We offer an optional Perth pre-assembly service ("Add Perth pre-assembly", A$600) for eligible rigs. If you add it to your order:

  • Area: the service is available for delivery addresses in Perth Metro only. Perth Metro means the 30 local government areas in the Perth Metropolitan Region Scheme area: Armadale, Bassendean, Bayswater, Belmont, Cambridge, Canning, Claremont, Cockburn, Cottesloe, East Fremantle, Fremantle, Gosnells, Joondalup, Kalamunda, Kwinana, Melville, Mosman Park, Mundaring, Nedlands, Peppermint Grove, Perth, Rockingham, Serpentine-Jarrahdale (including Byford), South Perth, Stirling, Subiaco, Swan, Victoria Park, Vincent and Wanneroo. Mandurah and the rest of the Peel region aren't included. If you're outside this area, please email us before ordering. If an order with pre-assembly comes through for an address outside the area and we can't provide the service, we'll refund the pre-assembly fee in full.
  • How it works: your rig is delivered from our supplier to our workshop, where we assemble it. We then deliver the assembled rig to you.
  • Timing: builds are scheduled within 5–15 business days from your order, depending on when the parts reach our workshop. We'll email you to arrange a delivery time. These are estimates, and we'll keep you updated by email if anything changes.
  • Access: please tell us about anything that affects delivery, such as stairs, narrow doorways or hallways, lifts, parking or gate codes, and the room the rig is going into. An assembled rig is large and heavy, so please check that it will fit through your doors and into the room. If you're unsure about access, contact us before your build is scheduled and we'll work out the options with you.
  • Cancelling the service: you can cancel the pre-assembly service for a full refund of its fee at any time before assembly starts. Once assembly has started, change-of-mind cancellation of the service isn't available. Your rights under the Australian Consumer Law for the service still apply (see section 10).

9. Returns and refunds
Our Refund policy explains how to return an item, including faulty, damaged or not-as-described items and change-of-mind requests. Please email us before sending anything back.

10. Consumer guarantees and manufacturer warranties
We don't offer a separate store warranty. Everything we sell, including our pre-assembly service, comes with the consumer guarantees under the Australian Consumer Law. Many products also come with a manufacturer's warranty, which is in addition to your consumer guarantee rights. You raise any problem with us, even if the item shipped from one of our suppliers. See Warranty & consumer guarantees.

11. Product information
We take care to make sure product descriptions, specifications, compatibility details and images are accurate. Much of this information comes from our suppliers and the manufacturer, and products can be updated by the manufacturer from time to time. Colours and finishes may look slightly different on your screen. If you're not sure whether a product suits your setup (for example, wheelbase or pedal compatibility), please email us before ordering. If an item you receive isn't as described, your rights under the Australian Consumer Law apply.

12. Intellectual property
The content on our website, including text, images, logos and design, is owned by us or used with permission from its owners, such as the manufacturer. You may view and print it for your own personal use. You may not copy, reproduce or use it commercially without our written permission. Brand names and trade marks belong to their respective owners.

13. Using our website
When using our website, you agree not to: use it for any unlawful purpose or in breach of these terms; place orders with false details or without authority to use the payment method; try to interfere with the website's security or operation, or introduce viruses or harmful code; or scrape, copy or harvest content or data from the website using automated tools without our permission.
We may refuse service or cancel orders (with a full refund) where we reasonably believe these terms have been breached.

14. Our liability

  • Our liability to you is governed by the Australian Consumer Law and these terms. Section 2 applies to everything in this section.
  • Goods or services of a kind not ordinarily acquired for personal, domestic or household use or consumption: to the extent the law allows, our liability for a failure to comply with a consumer guarantee (other than the guarantees about title, undisturbed possession and undisclosed securities) is limited, at our option, to: for goods, replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so; and for services, supplying the services again or paying the cost of having them supplied again. This limitation doesn't apply to goods or services ordinarily bought for personal, domestic or household use, which covers most of what we sell.
  • We aren't responsible for loss caused by your own misuse of a product, by not following the manufacturer's instructions, or by events outside our reasonable control. This doesn't limit your rights under the Australian Consumer Law.

15. Privacy
We handle your personal information as set out in our Privacy policy.

16. Governing law
These terms are governed by the laws of Western Australia, Australia. You and we can bring proceedings in the courts of Western Australia, or any other Australian court that has jurisdiction. This doesn't limit your right to contact a consumer protection agency, such as Consumer Protection WA, or the ACCC.

17. Changes to these terms
We may update these terms from time to time, for example when the law or our business changes. The updated version applies from the date it's posted on this page. The terms that applied when you placed your order continue to apply to that order.
